Policy

EVMS Medical Group must honor requests from attorneys for medical information provided proper authorization is attached in accordance with EVMS Medical Group Release of Information Policies. As a courtesy, notify the attending physician of all such requests. In addition, if an attorney requests a certified copy of the medical record the office manager and/or practice manager will complete an affidavit (see Forms) which will be attached to medical records to be forwarded to the attorney.

In the event that an attorney requests a patient’s medical record and a legal action against EVMS Medical Group or any of its physicians or other health care providers may result (i.e., there is no obvious reason for the request – no vehicular accident, worker’s compensation injury or injury resulting from use of a product), the EVMS Risk Management Office must be notified.
